Welcome to Oleve Health! By accessing this website or booking an appointment with Oleve Health, you agree to these Terms and Conditions.
These Terms and Conditions form an agreement between you and Oleve Health ("we", "us", "our"). If you are under 18 years of age, a parent or guardian must read and agree to these Terms on your behalf, and references to “you” include your parent or guardian where applicable.
These Terms apply to your use of this website and any products or services provided by Oleve Health. Please read them carefully alongside any policies or guidelines referenced on this website, including our Privacy Policy. Together, these documents form the “Terms”.
1. About Us
Oleve Health provides clinical nutrition consultation, education, and wellness services within Australia. Consultations are delivered online via Telehealth or in-person through our mobile clinic.

2. Your Responsibilities
By engaging our services, you acknowledge that you voluntarily consent to receive clinical nutrition services, assessments, education, and recommendations from Oleve Health. You may withdraw your consent at any time; however, doing so may affect our ability to provide services safely and effectively.
By engaging our products or services, you agree to:
Attend consultations on time or provide adequate notice if you need to cancel or reschedule;
Treat our practitioners, staff, and other clients with courtesy and respect at all times;
Complete any intake, consent, health history, or follow-up forms requested by us and provide information that is accurate, complete, and up to date;
Promptly notify us of any relevant changes to your health, medical history, medications, supplements, allergies, intolerances, pregnancy status, breastfeeding status, fertility treatment, recent vaccinations, dietary preferences or restrictions, or any other information that may impact the products or services provided to you;
Follow any reasonable health, safety, clinic, or Telehealth requirements communicated by us from time to time;
Engage with us honestly and in good faith; and
Comply with all applicable laws and these Terms.
If you are completing forms or providing information on behalf of a child or dependant, you confirm that you are authorised to do so and that the information provided is accurate to the best of your knowledge.
Email and other electronic communications are not monitored continuously and should not be used for urgent, emergency, or time-sensitive health concerns. We do not guarantee response times and recommend seeking immediate medical assistance where urgent care is required.
3. Scope of Practice
The information provided on this website, through our consultations, educational materials, webinars, downloadable resources, social media, emails, and other services is intended for general educational and informational purposes only and does not constitute medical advice, diagnosis, or treatment.
Oleve Health provides services through qualified clinical nutrition practitioners. Our services are designed to support general health and wellbeing through nutrition and lifestyle education; however, they are not a substitute for medical care, diagnosis, treatment, or advice provided by a doctor, specialist, psychologist, pharmacist, or other registered healthcare professional.
Oleve Health provides services within the practitioner's education, qualifications, professional training, and scope of practice. We may refer you to another healthcare provider where your needs fall outside our scope or where additional assessment, diagnosis, treatment, or management is required.
You should always seek independent medical advice from an appropriately qualified healthcare practitioner regarding any medical condition, symptoms, diagnosis, treatment options, medications, pathology results, or health concerns.
You should not disregard, delay, or discontinue medical advice or treatment based on information obtained through Oleve Health.
If you are experiencing severe symptoms, worsening health concerns, or a medical emergency, you should immediately seek urgent medical attention or contact emergency services.
Any recommendations provided by Oleve Health are based on the information disclosed by you and are intended to complement, not replace, appropriate medical care and collaborative healthcare management where required.
4. Telehealth Consultations
Oleve Health provides Telehealth consultations through Cliniko, a secure online practice management and video consultation platform. Telehealth allows us to provide clinical nutrition services remotely and gives you access to care from your chosen location.
By booking or participating in a Telehealth consultation, you acknowledge and agree that:
Telehealth consultations are conducted using electronic communication technologies, including video conferencing, email, messaging, and online platforms;
While we take reasonable steps to protect your personal information and use secure third-party platforms, no online communication or electronic storage system can be guaranteed to be completely secure;
You are responsible for ensuring you attend your consultation in a private and safe environment with a stable internet connection and suitable device access;
Technical difficulties, interruptions, delays, poor connection quality, or platform outages may occasionally occur and may impact the delivery of services;
Telehealth may not be appropriate or sufficient for all clinical situations, and we may recommend that you seek in-person medical care or other healthcare services where clinically appropriate;
You consent to receiving your treatment recommendations electronically;
You are responsible for providing accurate and up-to-date health information to support the safe delivery of Telehealth services; and
Personal and sensitive information collected during Telehealth consultations will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.
You consent to us communicating with you electronically for the purposes of providing consultations, treatment recommendations, resources, educational materials, invoices, appointment information, and related services. Telehealth consultations will not be recorded by either party without the prior consent of all participants.
5. Mobile Consultations
Oleve Health offers mobile clinical nutrition consultations at locations agreed between you and us, including residential addresses, workplaces, community settings, or other suitable locations. Mobile consultation services are offered within 20kms of our designated service area. Appointments located beyond 20kms may be available by arrangement and incur a $20 travel fee, quoted based on location. Availability of mobile consultations may vary based on location, travel requirements, scheduling capacity, and practitioner availability. We reserve the right to decline bookings outside our service area or to apply additional travel fees, which will be communicated before your appointment is confirmed.
By booking a mobile consultation, you acknowledge and agree that:
You are responsible for ensuring the consultation location is safe, clean, private, accessible, and suitable for the provision of professional health services;
Reasonable access, parking, and entry arrangements must be available at the agreed appointment time;
We reserve the right to refuse, discontinue, or reschedule a consultation where we reasonably believe the location presents a risk to health, safety, wellbeing, security, privacy, or professional standards;
We may refuse entry where aggressive, threatening, abusive, unlawful, unsafe, intoxicated, or inappropriate behaviour is present;
You are responsible for ensuring that any pets, hazards, distractions, or other factors that may interfere with the consultation are appropriately managed;
Mobile consultation appointments may be subject to geographic service areas, travel fees, minimum appointment requirements, or availability restrictions, which will be communicated to you before booking where applicable;
Travel delays caused by traffic, weather, emergencies, road closures, vehicle breakdowns, or circumstances outside our reasonable control may occasionally impact appointment times;
We will make reasonable efforts to notify you of any delays or required rescheduling; and
Where a mobile consultation cannot proceed safely or appropriately, we may offer an alternative appointment format, including Telehealth, where clinically suitable.
You acknowledge that mobile consultations involve attendance at third-party premises outside our control and agree to take reasonable steps to ensure a safe environment for all persons involved.
We reserve the right to leave or terminate a mobile consultation immediately where we reasonably believe there is a risk to safety, health, security, or professional boundaries.
6. Fees & Payment
Payment for consultations, educational webinars, downloadable resources, online programs, and digital products is processed securely through our booking and payment providers, including Cliniko and Stripe, or via invoice and direct debit where approved by us.
Unless otherwise agreed in writing:
Consultation fees are payable in full at the time of booking online;
Downloadable resources, PDF guides, webinars, and other digital products must be paid for in full prior to access being granted; and
Invoices issued by us must be paid within 24 hours of issue.
Access to digital products, webinar materials, recordings, or downloadable content may be suspended or withheld until payment has been received in full.
Due to the nature of digital products and educational content, refunds are not provided for downloadable resources, recordings, or digital materials once access has been provided, except where required under Australian Consumer Law.
We reserve the right to cancel, postpone, suspend, or withhold services or access where payment has not been received.
You authorise us and our third-party payment providers to process payments using your nominated payment method for fees owing in connection with the products or services provided to you.
7. Cancellation & Rescheduling Policy
Appointments are reserved specifically for you, and sufficient notice is appreciated to allow availability for other clients.
We require a minimum of 24 hours’ notice for any appointment cancellation or rescheduling request.
Where less than 24 hours’ notice is provided, we reserve the right to charge a cancellation fee equal to 50% of the scheduled consultation fee.
Appointments missed without notice (“no-shows”) may be charged at 100% of the full consultation fee.
Cancellation fees may be charged to your nominated payment method or added to your account and must be paid prior to booking any future appointments.
If you arrive late to your appointment, your consultation may be shortened to avoid delays for subsequent clients. The full consultation fee will still apply.
If you experience technical difficulties during a Telehealth consultation, please contact us as soon as possible via email. Where reasonable and practicable, we will attempt to reconnect or reschedule the appointment at our discretion.
We understand that unexpected circumstances may occasionally arise and may, at our sole discretion, waive or reduce cancellation fees in exceptional situations.
We reserve the right to reschedule, postpone, or cancel appointments where reasonably necessary, including due to practitioner illness, emergencies, technical issues, or circumstances outside our reasonable control. Where this occurs, we will make reasonable efforts to offer an alternative appointment time.
By booking an appointment with Oleve Health, you acknowledge and agree to this Cancellation and Rescheduling Policy.
8. Refunds
Due to the time, preparation, professional expertise, and administrative resources involved in providing our services, consultation fees are generally non-refundable once a consultation has taken place.
Refund requests may be considered on a case-by-case basis at the sole discretion of Oleve Health, including where required under Australian Consumer Law.
To the maximum extent permitted by law, we do not provide refunds for:
Change of mind;
Failure to implement recommendations or treatment plans;
Dissatisfaction with outcomes where services have been provided professionally and with reasonable care; or
Missed appointments or late cancellations subject to our Cancellation & Rescheduling Policy.
Digital products, downloadable resources, educational materials, online programs, recordings, PDF guides, and other electronic content are generally non-refundable once purchased or accessed due to the immediate and irrevocable nature of digital delivery.
Where a live webinar, program, or event is cancelled by us and cannot be reasonably rescheduled, you may be offered:
A refund;
Credit toward another service or program; or
Access to alternative materials or recordings,
at our discretion and where appropriate.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under Australian Consumer Law that cannot lawfully be excluded.
9. Refusal of Service
We are committed to providing our services in a professional, ethical, and safe manner. However, we reserve the right to refuse, suspend, or discontinue services where reasonably necessary, including where:
You do not comply with these Terms;
We reasonably believe that providing the service may be unlawful, inappropriate, unethical, or outside our professional scope of practice;
Continuing the practitioner-client relationship may pose a risk to the health, safety, wellbeing, or rights of any person; or
We reasonably determine that we are unable to provide services safely or effectively.
Where appropriate and reasonably practicable, we may provide notice of the refusal, suspension, or discontinuation of services.
10. Results Disclaimer
Oleve Health provides clinical nutrition services, education, and general wellness support designed to support your health goals. However, individual responses to nutrition, lifestyle, and supplement recommendations may vary significantly between individuals.
We do not guarantee any specific health, medical, fertility, hormonal, weight-related, or therapeutic outcomes from the use of our services, products, recommendations, educational materials, or resources.
Your results may be influenced by a range of factors outside our control, including but not limited to:
Your medical history and current health status;
Genetics and underlying conditions;
Medications and existing treatments;
Adherence to recommendations;
Dietary and lifestyle factors;
Stress, sleep, and environmental influences; and
The involvement of other healthcare providers.
Our services are not intended to diagnose, treat, cure, or prevent any disease and should not replace medical advice, diagnosis, or treatment provided by a medical practitioner or other qualified healthcare provider.
You should seek advice from your doctor or qualified healthcare practitioner before making significant dietary, supplement, exercise, or lifestyle changes, particularly if you:
Are pregnant or breastfeeding;
Are trying to conceive;
Are taking prescription medication;
Have a diagnosed medical condition;
Are undergoing medical treatment; or
Have a history of allergies, eating disorders, or complex health conditions.
You acknowledge that any decisions you make in relation to your health, nutrition, supplementation, or lifestyle are made voluntarily and at your own discretion.
11. Intellectual Property
“Oleve Health”, including our business name, logo, branding, graphics, website content, educational materials, downloadable resources, treatment frameworks, and related branding elements, are owned by or licensed to Oleve Health and are protected by applicable intellectual property, copyright, trademark, and consumer protection laws.
Unless otherwise indicated, as between you and Oleve Health, we own all rights, title, and interest, including intellectual property rights, in and to our website, services, resources, products, programs, materials, treatment plans, educational content, and all information provided to you in connection with the delivery of our products and services.
Your use of our website, products, or services, and your submission of personal information to us, including health information, does not transfer or grant to you any ownership rights in our intellectual property, products, services, or materials.
Any trademarks, business names, logos, or branding used by Oleve Health, whether registered or unregistered, must not be copied, reproduced, imitated, modified, used, or distributed without our prior written consent, including the use of any names, branding, or marks that are substantially similar or likely to cause confusion.
All content and materials provided through our website, consultations, webinars, educational resources, treatment plans, handouts, PDFs, protocols, meal guides, programs, emails, social media, and digital products are provided for your personal, non-commercial use only.
Unless otherwise permitted by law or with our prior written consent, you must not:
Reproduce, copy, record, modify, publish, distribute, transmit, display, sell, licence, or commercially exploit our materials;
Share, upload, or distribute paid, confidential, or practitioner-only resources to third parties;
Use artificial intelligence tools or systems to reproduce, distribute, commercialise, republish, or create competing materials from our content without prior written consent;
Use our content for commercial, educational, or training purposes; or
Represent our materials, recommendations, or intellectual property as your own.
You may download or print materials provided by us solely for your personal use in connection with the services provided to you.
Unauthorised use of our intellectual property may result in legal action.
12. Adverse Reactions
You acknowledge that therapeutic supplements, nutritional products, and wellness-related products may affect individuals differently and may carry potential risks, side effects, sensitivities, intolerances, or interactions.
If you experience any adverse reaction, side effect, intolerance, worsening of symptoms, allergic reaction, or other unexpected response in connection with any supplement, product, recommendation, or service, you should:
Discontinue use immediately where appropriate;
Seek prompt medical advice or emergency assistance where required; and
Notify Oleve Health as soon as reasonably practicable with relevant details of the reaction.
You are responsible for reviewing product ingredients, dosage instructions, warnings, and manufacturer information before using any therapeutic supplement or product recommended, discussed, or supplied through our services.
You should consult an appropriate healthcare practitioner before commencing any supplement or nutritional protocol, particularly if you:
Are pregnant or breastfeeding;
Are trying to conceive;
Are taking prescription medication;
Have allergies, sensitivities, or intolerances;
Have a diagnosed medical condition; or
Are under the care of another healthcare provider.
Recommendations provided by Oleve Health are based on the information disclosed by you at the time of consultation. Failure to provide accurate, complete, and up-to-date health information, including medications, allergies, medical conditions, or supplement use, may affect the suitability and safety of recommendations provided.
To the maximum extent permitted by law, including under the Australian Consumer Law, Oleve Health excludes liability for any loss, injury, illness, adverse reaction, allergic response, side effect, or damage arising from:
The use or misuse of therapeutic supplements or products;
Failure to follow product instructions or professional advice;
Undisclosed allergies, sensitivities, medications, or medical conditions; or
Reliance on information provided through our services, website, educational materials, or digital content.
Nothing in these Terms excludes any consumer guarantees, rights, or remedies that cannot lawfully be excluded under Australian law
13. Use of Services
Your use of the products and services provided by Oleve Health is for personal, non-commercial purposes only. You agree not to reproduce, distribute, publish, duplicate, copy, share, modify, sell, licence, or otherwise exploit any part of our products, services, educational materials, programs, treatment plans, protocols, resources, or digital content for commercial purposes or personal financial gain without our prior written consent.
Certain materials, resources, practitioner information, educational content, protocols, and documents provided through Oleve Health may contain confidential or proprietary information. You agree to keep such information confidential and not disclose, share, reproduce, or distribute it to any third party without our prior written permission, which may be withheld at our discretion.
Nothing in these Terms prevents you from sharing your own personal health information, treatment plans, recommendations, pathology results, or supplement information with your medical practitioner, primary healthcare provider, allied health practitioner, pharmacist, or other relevant healthcare professionals involved in your care. In many circumstances, we encourage collaborative care to support safe and appropriate health management.
14. Privacy
As an allied health and clinical nutrition service provider, Oleve Health is committed to handling your personal and health information in accordance with applicable Australian privacy and confidentiality obligations, including:
The Privacy Act 1988 (Cth);
The Australian Privacy Principles (APPs); and
Applicable Australian health records, privacy, and confidentiality laws.
We take reasonable steps to protect the confidentiality, security, and integrity of your personal and sensitive health information. However, you acknowledge that electronic communications and online platforms may carry inherent privacy and security risks.
We may use third-party service providers to facilitate bookings, payments, communications, Telehealth consultations, electronic records, educational resources, and practice management functions. While we take reasonable care in selecting providers, we are not responsible for the operation, availability, security, or performance of third-party services outside our reasonable control.
Your personal information will only be collected, used, disclosed, or stored in accordance with our Privacy Policy, applicable laws, and professional obligations. We will not disclose your personal or health information to third parties without your consent unless:
Required or authorised by law;
Necessary to prevent a serious threat to health or safety;
Required for mandatory reporting obligations; or
Otherwise permitted under applicable privacy legislation.
You acknowledge that de-identified or aggregated information may be used for administrative, educational, quality assurance, legal, or practice management purposes where permitted by law.
You may request access to, or correction of, your personal information in accordance with applicable privacy laws.
The practice maintains social media and online platforms for educational and informational purposes only. Clients should not use social media messaging, comments, or public posts to communicate personal health information or seek clinical advice. While reasonable steps are taken to protect information shared through approved communication channels, the practice cannot guarantee the privacy or security of information transmitted via third-party social media platforms. Any information shared by clients through these platforms is at their own discretion and risk.
We retain client health records in accordance with applicable legal, regulatory, insurance, and professional record-keeping obligations. In most circumstances, health records will be retained for a minimum of seven (7) years from the date of the last consultation, or longer where required by law. Requests for deletion of personal information may be subject to these retention obligations. Health records relating to minors may be retained for longer periods where required by applicable law.

15. Limitation of Liability
To the maximum extent permitted by law, including under the Australian Consumer Law, Oleve Health excludes all liability for any indirect, incidental, special, consequential, or economic loss arising out of or in connection with the use of our website, products, services, consultations, educational materials, digital resources, recommendations, or information provided by us.
To the extent permitted by law, our total liability for any claim arising out of or relating to our services will be limited to:
Re-supplying the relevant service;
Providing the service again; or
Refunding the amount paid for the relevant service,
as determined by us where permitted by law.
Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation. You acknowledge that our services are educational and supportive in nature and that you remain responsible for decisions relating to your healthcare, treatment, and wellbeing.
16. Pathology & Supplemental Third Party Services
Any pathology, functional testing, genetic testing, microbiome testing, wearable health technology, third-party applications, or other external services are provided by independent providers. Oleve Health is not responsible for laboratory services, turnaround times, testing accuracy, specimen handling, or third-party reports.
Any supplements or products recommended by Oleve Health are supplied by independent manufacturers and distributors. We do not guarantee product availability, efficacy, manufacturing practices, or outcomes associated with their use.
17. Force Majeure
We are not liable for delays, interruptions, cancellations, or inability to provide services due to events outside our reasonable control, including natural disasters, pandemics, power outages, telecommunications failures, cyber incidents, government restrictions, illness, emergencies, or supplier disruptions.
18. Changes to These Terms
Oleve Health reserves the right to amend, update, or modify these Terms and Conditions from time to time at our discretion.
Any updated version will be published on our website and will take effect from the date of publication unless otherwise stated.
We encourage you to review these Terms periodically to ensure you remain informed of any changes.
Your continued use of our website, products, services, Telehealth consultations, digital resources, or online platforms after updated Terms are published constitutes your acceptance of those changes.
Where a material change may significantly affect your rights or obligations, we may take reasonable steps to notify you, including by email, website notice, or through our booking platform.
19. Governing Law
These Terms and Conditions are governed by the laws of South Australia, Australia, regardless of where the client is located.
You agree to submit to the exclusive jurisdiction of the courts of South Australia and any courts entitled to hear appeals from those courts in relation to any dispute arising out of or in connection with these Terms, our website, products, or services.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue in full force and effect.
